1. Acceptance of terms
By registering, accessing, or using Nautic Garage (“the Service”), you agree to be bound by these Terms and Conditions (“the Terms”). If you do not agree with any part of these Terms, you must not create an account or use the Service.
These Terms constitute a legally binding agreement between you (“the User”, “you”) and Btm International Inc.
We reserve the right to modify these Terms at any time. Material changes will be notified:
- By email to your registered address, at least 15 days before the change takes effect.
- Via an in-app notice displayed on next login.
Continued use of the Service after the changes take effect constitutes acceptance of the new Terms. If you do not agree with the revised Terms, your sole remedy is to stop using the Service and delete your account.
2. Description of the Service
Nautic Garage is a SaaS (Software as a Service) platform for comprehensive vessel management, enabling users to:
- Register and manage vessels, equipment, and engines.
- Manage nautical documentation (licenses, registrations, certificates, insurance).
- Plan and record preventive and corrective maintenance.
- Track vessel-related expenses.
- Receive alerts and reminders for expiries, engine hours, and scheduled maintenance.
- Share vessel access with other users (family, crew, trusted contacts).
- Export technical data sheets in PDF format.
The Service is offered under a freemium model with paid subscription plans that unlock additional features and higher usage limits.
3. Account registration & eligibility
3.1 Age requirements
By creating an account, you represent and warrant that you meet the minimum age of digital consent in your jurisdiction:
- EU/EEA: 16 years (or the age set by your member state, minimum 13).
- United Kingdom: 13 years.
- United States: 13 years (or older if required by your state).
- United Arab Emirates: 18 years (21 for certain legal acts under UAE civil law).
If you are under the applicable age, you must have verifiable parental or guardian consent to use the Service.
3.2 Account obligations
- You must provide true, accurate, and complete registration information.
- You are responsible for keeping your account information up to date.
- One person may hold only one account per email address.
- You are solely responsible for maintaining the confidentiality of your login credentials (email and password).
- Any activity conducted through your account is deemed to be conducted by you.
- You must notify us immediately at support@nauticgarage.io if you suspect unauthorized access.
- We strongly recommend enabling biometric authentication (Face ID / Touch ID / fingerprint) on supported devices.
3.3 Account closure
You may close your account at any time via Settings → Security → Delete my account and data. Account deletion is permanent and irreversible after the 30-day grace period. Data required by applicable law (e.g., tax records, invoices) will be retained for the legally mandated period in your jurisdiction.
We reserve the right to suspend or terminate accounts that:
- Violate these Terms.
- Engage in fraudulent, illegal, or abusive conduct.
- Pose a legal, security, or reputational risk to Nautic Garage, its users, or third parties.
4. Plans, subscriptions & payments
4.1 Available plans
Nautic Garage offers multiple subscription tiers. Plan details — including price (in your local currency where supported), included features, and limits (vessels, guests, equipment items, documents, maintenance events per vessel) — are displayed in the Subscription section within the app and on our website.
4.2 Free plan
The free plan is subject to usage limitations. We reserve the right to modify free plan features and limits at any time.
4.3 Paid subscriptions
- Subscriptions are billed in advance on a monthly or annual cycle, as selected by the User.
- Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. You will be charged for the renewal within 24 hours prior to the end of the current period, at the then-current price.
- Prices are displayed in the currency applicable to your App Store / Play Store region, or in EUR/USD/GBP for web (Stripe) subscriptions. Prices include applicable taxes (VAT, GST, sales tax) as required by law in your jurisdiction.
- We may change pricing. You will be notified of any price change at least 30 days in advance. The new price will apply at your next renewal. If you do not agree with the new price, you may cancel before the renewal date.
Apple App Store & Google Play Store subscriptions: When you purchase a subscription through Apple’s App Store or Google’s Play Store, the respective store acts as the merchant of record. Your subscription is additionally governed by the Apple Media Services Terms and Conditions or the Google Play Terms of Service, as applicable. Payment processing, billing, and certain refund determinations are handled by the store, not by Nautic Garage.
4.4 Subscription management & cancellation
You may manage your subscription (upgrade, downgrade, switch between monthly/annual, cancel) via:
- Web (Stripe): Settings → Subscription → Manage subscription (Stripe Customer Portal).
- iOS (Apple App Store): Device Settings → Apple ID → Subscriptions.
- Android (Google Play Store): Play Store → Payments & Subscriptions → Subscriptions.
Cancellation takes effect at the end of the current billing period. No partial refunds are issued for mid-cycle cancellations, except where required by applicable law.
4.5 Refunds
- Web subscriptions (Stripe): Refund requests are evaluated on a case-by-case basis. Contact support@nauticgarage.io.
- iOS subscriptions (Apple): Managed by Apple per Apple’s refund policy.
- Android subscriptions (Google): Managed by Google per Google’s refund policy.
- Right of withdrawal (EU/EEA & UK): As a consumer, you have a statutory right to withdraw from a distance contract within 14 calendar days from the date of purchase. HOWEVER, by initiating your subscription and accessing the Service, you expressly acknowledge that the Service begins immediately, and you waive the right of withdrawal for the period already consumed. The withdrawal right does not apply after the 14-day period has elapsed.
- UAE consumers: Similar cooling-off periods may apply under UAE Consumer Protection Law (Federal Law No. 15 of 2020). Contact us for details.
- US consumers: Refund policies vary by state. Contact us — we aim to treat all users fairly.
4.6 Chargebacks & payment disputes
If you initiate a chargeback or payment dispute with your bank or card issuer without first contacting us to resolve the issue, we reserve the right to suspend your account pending resolution.
5. Acceptable use
5.1 Permitted use
Nautic Garage is designed for personal recreational vessel management. You may use it to:
- Manage your own vessels.
- Share access with family members, crew, or trusted contacts.
- Maintain maintenance logs and document records.
- Export vessel data sheets for your own use.
5.2 Prohibited use
You agree NOT to:
- Use the Service for commercial fleet management, charter operations, or boat rental businesses without a separate commercial agreement with us.
- Submit false, fraudulent, or third-party data without the data subject’s consent.
- Use the Service for any illegal or unauthorized purpose.
- Attempt to access another user’s data or account without authorization.
- Reverse-engineer, decompile, disassemble, or extract the source code of the Service.
- Use bots, scrapers, crawlers, or any automated means to access or interact with the Service.
- Overload, attack, or disrupt the Service (DoS, DDoS, or other infrastructure attacks).
- Upload, transmit, or store malware, viruses, ransomware, or any malicious code.
- Share your account credentials with unauthorized third parties.
- Resell, sublicense, rent, lease, or redistribute access to the Service without our express written permission.
- Use the Service to store or process sensitive personal data (as defined by GDPR/CCPA/PDPL) of third parties without our prior written acknowledgement.
- Violate any applicable laws or regulations, including export controls, sanctions regimes, or anti-money laundering regulations.
Violation of these prohibitions may result in immediate account suspension or termination without prior notice and without refund.
6. User content
6.1 Ownership
You retain full ownership of all data, text, documents, photos, and files you upload or enter into the Service (“User Content”).
6.2 Limited license to the provider
By submitting User Content to the Service, you grant Btm International Inc a non-exclusive, worldwide, royalty-free, limited license to use, store, process, and display such content solely for the purposes of:
- Providing the Service to you.
- Generating PDF data sheets you request.
- Sharing data with users you have invited to your vessels (according to the permission level you assign them).
- Creating technical backups.
- Complying with legal obligations.
This license terminates when you delete the User Content from the Service, or when your account is closed, except where we are required to retain data by law.
6.3 Your responsibility
You are solely responsible for:
- The accuracy and legality of all User Content you submit.
- Ensuring you have the necessary rights to any files you upload (photos, scanned documents).
- Not infringing the intellectual property, privacy, or publicity rights of any third party.
- Not submitting personal data of third parties without their informed consent, as required by applicable data protection law.
7. Intellectual property
7.1 Service IP
Nautic Garage, its source code, design, logo, user interface, trade name, trademarks, text, graphics, and all other elements of the Service are the exclusive property of Btm International Inc or its licensors, and are protected by copyright, trademark, trade dress, and other intellectual property laws throughout the world.
Nothing in these Terms grants you any right, title, or license to the Service’s intellectual property, except the limited, revocable, non-transferable right to use the Service as set forth herein.
7.2 User-generated output
PDF data sheets and reports generated from your User Content are your property. You may use, share, and distribute them freely.
7.3 Feedback
Any suggestions, ideas, comments, or feedback you provide about the Service may be used by us without restriction, compensation, or confidentiality obligation, unless otherwise agreed in writing.
8. Third-party services & integrations
The Service integrates with the following third-party platforms:
- Supabase: Database and authentication infrastructure.
- Stripe: Payment processing (web subscriptions).
- Apple App Store & Google Play Store: Payment processing and app distribution (mobile).
- OneSignal: Push notification delivery.
- Google OAuth: Authentication via Google account.
We are not responsible for the availability, performance, terms, or privacy practices of these third-party services. Your use of them is governed by their respective terms and policies. We disclaim all liability arising from your use of or reliance on any third-party service.
9. Service availability & modifications
9.1 Availability
We use commercially reasonable efforts to maintain Service availability 24/7/365, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (notified in advance where feasible).
- Emergency maintenance or security incidents.
- Failures of third-party infrastructure providers (Supabase, CDN, DNS, etc.).
- Force majeure events beyond our reasonable control.
9.2 Modifications
We reserve the right to modify, update, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. For significant changes that materially reduce core functionality, we will provide reasonable advance notice and, where applicable, a pro-rata refund for the remaining prepaid period of a paid subscription.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Warranties regarding the accuracy, completeness, or reliability of calculations, alerts, reminders, or any other data generated by the Service.
Nautic Garage is a vessel management support tool. It does not replace professional judgment. You are solely responsible for:
- Verifying the accuracy of all data entered into the Service.
- Making decisions based on information provided by the Service.
- Compliance with all applicable maritime, safety, environmental, and customs laws and regulations.
- Maintaining independent backups of critical documents.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Btm International Inc, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to: loss of profits, loss of revenue, loss of data, loss of use, business interruption, damage to vessels, personal injury or death, or any other loss or damage arising from or relating to the use of or inability to use the Service, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.
- The total aggregate liability of Btm International Inc for all claims arising from or relating to these Terms or the Service shall not exceed the total amount paid by you to us for the Service during the 12 months immediately preceding the event giving rise to the claim.
- If applicable law does not permit the exclusion or limitation of certain warranties or liabilities, these exclusions and limitations shall apply to the maximum extent permitted by such law.
11.1 Non-excludable liability
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot lawfully be excluded or limited under applicable mandatory law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Btm International Inc, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party right, including intellectual property, privacy, or publicity rights.
- User Content you submit to the Service.
- Your violation of any applicable law or regulation.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense.
13. Dispute resolution & governing law
13.1 Good-faith resolution
Before initiating any formal legal proceeding, both parties agree to attempt in good faith to resolve any dispute informally. Contact us at legal@nauticgarage.io to initiate this process. We will acknowledge your communication within 10 business days and work with you to find a resolution.
13.2 Governing law
These Terms shall be governed by and construed in accordance with:
- For users in the European Union / EEA: the laws of Spain, without regard to conflict of laws principles. As a consumer, you also benefit from the mandatory consumer protection provisions of your country of residence.
- For users in the United Kingdom: the laws of England and Wales.
- For users in the United States: the laws of the State of Delaware, without regard to conflict of laws principles, except where your state’s consumer protection laws require otherwise.
- For users in the United Arab Emirates: the laws of the UAE as applied in the Emirate of Dubai, subject to the mandatory consumer protections of UAE Federal Law No. 15 of 2020.
- For users in all other jurisdictions: the laws of Spain, without regard to conflict of laws principles, subject to the mandatory consumer protection provisions of your country of residence.
13.3 Arbitration
For users in the United States: any dispute not resolved informally within 60 days may be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Miami, Florida or remotely via videoconference at your election. You may also bring a claim in small claims court in your county of residence if within that court’s jurisdiction. CLASS ACTION WAIVER: All claims must be brought in the parties’ individual capacity. You waive any right to participate in a class action, class-wide arbitration, or any other representative proceeding.
For users in the EU/EEA, UK, and UAE: you retain the right to bring proceedings in the courts of your place of habitual residence.
13.4 Online dispute resolution (EU)
Consumers residing in the EU may also use the European Commission’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
13.5 Time limit for claims
Any claim arising from or related to these Terms must be filed within one (1) year after the cause of action accrues, or within the longer period prescribed by applicable mandatory law. After that period, the claim is permanently barred.
14. Vessel sharing
The Service allows you to share access to your vessels with other registered users:
- Read-only: The guest can view all vessel data but cannot modify it.
- Editor: The guest can view and modify data, add maintenance events, upload documents, etc.
As the vessel owner, you are responsible for:
- Properly managing guest permissions.
- Revoking access when no longer needed.
- Any actions performed by guests on your data through the Service.
Nautic Garage is not a party to, and disclaims all liability for, any disputes between vessel owners and guests arising from shared access.
15. Vessel transfers
The Service allows transferring vessel ownership to another registered user via a transfer code. A transfer entails the complete handover of all vessel-associated data (maintenance history, documents, insurance records, expenses, etc.) from the transferor to the transferee. Once completed:
- The transferee assumes full responsibility for the data.
- The transferor loses all access to the vessel and its associated data.
- The transfer is irreversible.
Nautic Garage acts solely as a technical facilitator of the transfer. We do not intermediate or mediate in the sale price, payment terms, or any other commercial conditions between private parties. We make no representations regarding the legal validity of the transfer for purposes of vessel title registration or ownership under maritime law.
16. Notices
All communications and notices relating to these Terms shall be delivered:
- From provider to User: Via email to the address registered to the account, or via in-app notice.
- From User to provider: Via email to support@nauticgarage.io (general), privacy@nauticgarage.io (data protection), or legal@nauticgarage.io (legal matters).
Email notices shall be deemed received 24 hours after sending, unless we receive a delivery failure notification.
17. General provisions
17.1 Assignment
You may not assign or transfer these Terms, or your rights or obligations hereunder, without our prior written consent. We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate restructuring, or sale of substantially all of our assets, without your consent.
17.2 Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.
17.3 No waiver
Our failure or delay in exercising any right or provision under these Terms shall not constitute a waiver of such right or provision. A waiver shall only be effective if made in writing and signed by an authorized representative.
17.4 Relationship
Nothing in these Terms creates a partnership, joint venture, agency, fiduciary, or employment relationship between you and Btm International Inc. You are an independent contractor.
17.5 Entire agreement
These Terms, together with the Privacy Policy and any other policies or guidelines expressly incorporated by reference, constitute the entire agreement between you and Btm International Inc regarding the Service, and supersede all prior or contemporaneous agreements, communications, or proposals, whether oral or written, between the parties.
17.6 Survival
Sections concerning intellectual property (§7), disclaimers (§10), limitations of liability (§11), indemnification (§12), dispute resolution (§13), and general provisions (§17) shall survive any termination or expiration of these Terms.
17.7 Force majeure
Neither party shall be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargoes, civil or military authority, fire, floods, earthquakes, pandemics, strikes, labor shortages, internet or telecommunications failures, or actions of third-party infrastructure providers.
17.8 Export compliance
You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to comprehensive economic sanctions administered by the United States, European Union, United Kingdom, or United Nations. You agree not to use the Service for any purpose prohibited by applicable export control or sanctions laws.

Annex A — Definitions
- Service: The Nautic Garage platform, including mobile applications (iOS, Android), web application, APIs, and all features and content offered through them.
- User / You: The individual or entity that has registered an account and uses the Service.
- User Content: All data, text, photos, documents, and files submitted or uploaded by the User to the Service.
- Vessel: Any boat, sailboat, motorboat, dinghy, jet ski, or other recreational watercraft registered by the User on the Service.
- Guest: A registered User who has been granted shared access to another User’s vessel.
- Plan: The set of features and usage limits available to the User according to their subscription tier.
- Billing period: The monthly or annual cycle for which the subscription is billed.
